Очікувана вартість закупівлі формувалася виходячи з тарифу на електроенергію як універсальну послугу (яка включає в себе послугу розподілу електричної енергії), однак згідно умов тендерної документації дана умова (щодо розподілу електричної енергії) прямо не була передбачена. Однак враховуючи, те що внести зміни до документації на даному етапі торгів не можливо, для можливості виключення дискримінаційного підходу, пропонується відмінити відкриті торги.
