Explanation

Згідно з пунктом 6 частини 1 статті 1 нового Закону про публічні закупівлі (далі – Закон) договір про закупівлю – господарський договір, що укладається між замовником і учасником за результатами проведення процедури закупівлі/спрощеної закупівлі та передбачає платне надання послуг, виконання робіт або придбання товару. Допорогова закупівля не є процедурою закупівлі в розумінні Закону про публічні закупівлі. Отже, у разі якщо суб’єктом, який є замовником у розумінні нової редакції Закону, з 19.04.2020 передбачено придбання товарів, робіт або послуг, така закупівля здійснюється відповідно до вимог нової редакції Закону, керуючись вартісними межами, визначеними статтею 3 нової редакції Закону. Враховуючи вищевикладене, у разі якщо замовник не встиг з певних причин укласти договір про закупівлю за результатами допорогової закупівлі до 18.04.2020 включно, йому слід відмінити таку допорогову закупівлю та керуючись вартісними межами, встановленими у частині 1 статті 3 Закону, проводити спрощену закупівлю або укладати договір про закупівлю без використання електронної системи закупівель у випадках, передбачених у частині 7 статті 3 Закону.
