Description:

«Замовник» може перерахувати «Підряднику» попередню оплату відповідно до вимог постанови Кабінету Міністрів України від 04.12.2019 № 1070 та постанови Кабінету Міністрів України від 27.12.2001 №1764 (із змінами). Попередня оплата може надаватися у розмірі до 30 відсотків річного обсягу фінансування в межах строку, який установлено абз. 3 п.1 постанови Кабінету міністрів України від 04.12.2019 № 1070. Загальний обсяг попередньої оплати не може перевищувати 30% договірної ціни. Розмір і кількість платежів у рамках розміру, що зазначено абз. 2 п. 4.2 даного договору, визначається виходячи із реального стану виконання робіт, помісячного розподілу бюджетних асигнувань, сезонністю робіт, тощо. «Підрядник» зобов'язується використати кожну частину отриманої попередньої оплати протягом трьох місяців після одержання оплати. При терміні виконання робіт, визначеному у графіку виконання робіт (Додаток №2 до договору), меншому ніж три місяці, «Підрядник» зобов'язується використати отриману попередню оплату до спливу цього терміну. По закінченні терміну невикористані кошти повертаються на рахунок «Замовника», але не пізніше останнього дня терміну відпрацювання попередньої оплати. Попередня оплата здійснюється шляхом спрямування бюджетних коштів на небюджетні рахунки «Підрядника», відкриті на його ім’я в органах Державної казначейської служби у встановленому законодавством порядку відповідно до вимог п. 2 постанови Кабінету Міністрів України від 04.12.2019 №1070. «Підрядник» підтверджує використання коштів отриманої попередньої оплати актами виконаних підрядних робіт, складених за формою КБ 2в, і довідками про вартість виконаних підрядних робіт, складених за формою КБ 3.

Description:

Оплата здійснюється поетапно проміжними платежами на підставі підписаних сторонами актів виконаних підрядних робіт, складених за формою КБ-2в, актів змонтованого або встановленого обладнання і довідок про вартість виконаних підрядних робіт, складених за формою КБ-3. Строк оплати – 35 робочих днів – є орієнтовним і в будь-якому разі розрахунки проводяться в період дії договору.

Замовник має право здійснювати кінцевий розрахунок у розмірі до 5 % від Договірної ціни, після виконання і приймання всіх передбачених Договором робіт, отримання документа про готовність об’єкта до експлуатації, протягом 35 робочих днів з дня передачі об’єкта експлуатуючій організації, при відсутності обмеження руху коштів по казначейським рахункам, а у разі настання останньої події в іншому бюджетному році, ніж в якому проводилося виконання робіт - при наявності лімітних призначень у поточному році та коштів на казначейських рахунках
