Відповідно до п.5 Розділу 10 «Прикінцеві та перехідні положення» нової редакції Закону «Про публічні закупівлі» №114-ІХ від 19.09.2019 р. (далі –Закон) процедури закупівель товарів, робіт і послуг, розпочаті до введення в дію цього Закону, завершуються відповідно до порядку, що діяв до введення в дію цього Закону». Відтак, враховуючи те, що допорогова закупівля не була врегульована на рівні Закону та не є процедурою закупівлі в розумінні Закону, а отже, у разі якщо замовник не уклав договір про закупівлю за результатами допорогової закупівлі до 19.04.2020 р. включно, слід відмінити таку допорогову закупівлю.
