Відповідно до Листа Міністерства розвитку економіки, торгівлі та сільського господарства України №3304-0455553-06 від 21.12.2019р. "Щодо набрання чинності на введення в дію нового Закону "Щодо завершення процедур закупівель, розпочатих до введення в дію нової редакції Закону. Відповідно до п. 5 Розділу 10 "Прикінцеві та перехідні положення" нової редакції Закону процедур закупівель товарів, робіт, і послуг, розпочаті до введення в дію цього Закону, завершуються відповідно до пордку, що діяв до введення в дію цього Закону". Враховуючи те що допорогова закупівля не була врегульвана на рівні Закону України "Про публічні закупівлі" та не є процедурою закупівлі в розумінні Закону, а отже у разі якщо замовник не уклав договір про закупілю за результатами допорогової закупівлі до 18.04.2020р. включно, слід відмінити допорогову закупівлю.
