Explanation

Оголошення про проведення процедури закупівлі оприлюднено Замовником відповідно до положень частини 3 статті 10 Закону України «Про публічні закупівлі» № 922-VIII від 25.12.2015 (далі – Закон). У складі тендерної пропозиції учасника міститься файл «Цінова пропозиція», який у порушення вимог абзацу 3 частини 1 статті 28 Закону до розкриття тендерних пропозицій є доступним до перегляду. Враховуючи наведене, розкриття інформації про ціну учасника на етапі, коли розкри-ваються всі файли тендерної пропозиції, крім інформації про ціну/приведену ціну тендер-ної пропозиції, є порушенням законодавства у сфері публічних закупівель. Слід зазначити, що наведені вище обставини призвели до порушень, які неможливо усунути. Відповідно до пункту 2 частини 1 статті 32 Закону замовник відміняє тендер, зокрема, в разі неможливості усунення порушень, що виникли через виявлені порушення законодав-ства у сфері публічних закупівель. Враховуючи Рішення №10523-р/пк-пз від 12.10.2018 Постійно діючої адміністративної колегії Антимонопольного комітету України процедура закупівлі підлягає відміні, у зв’язку з неможливістю усунення порушень, що виникли через виявлені порушення законодавства з питань публічних закупівель.
