В порушення пункту 1.1. розділу 3 «Інструкція з підготовки тендерної пропозиції» Учасником в тендерній пропозиції не надано:  документи, які учасник подає у складі тендерної пропозиції для підтвердження відповідності вимогам ТД, згідно з умовами та вимогами Таблиці 1 Додатку 2 до ТД, а саме: - Технічну документацію виробника, для підтвердження відповідності вимогам Технічної специфікації; - Єдину декларацію про відповідність товару вимогам Технічного регламенту низьковольтного електричного обладнання, затвердженого постановою Кабінету Міністрів України від 16 грудня 2015 р. № 1067 та Технічного регламенту з електромагнітної сумісності обладнання постановою Кабінету Міністрів України від 16 грудня 2015 р. № 1077.  письмове погодження учасника із проєктом договору про закупівлю, який викладений в Додатку 2 до ТД (форма погодження наведена у Додатку № 2/1 до ТД).  інформацію про необхідні технічні, функціональні та якісні характеристики предмета закупівлі у вигляді тендерної форми Технічні вимоги, згідно з Додатком 4 до ТД. В порушення пункту 1.5. розділу 3 Тендерної документації «Інструкція з підготовки тендерної пропозиції», якщо пропозиція містить скановані документи і документи в електронній формі, то учасник повинен накласти ЕЦП/КЕП на пропозицію в цілому та на кожен електронний документ окремо. Учасником не накладено КЕП/ЕЦП на тендерну пропозицію, яка була оприлюднена в електронній системі закупівель 01.10.2020 о 13:43. Враховуючи вищевикладене, тендерна пропозиція учасника ТОВАРИСТВО З ОБМЕЖЕНОЮ ВІДПОВІДАЛЬНІСТЮ «ДАРЕКС-ЕНЕРГО» підлягає відхиленню на підставі абз. 3 пункту 1 та абз. 2 пункту 2 частини першої статті 31 Закону України «Про публічні закупівлі».

В порушення абз. 4 пункту 1.1. розділу 3 «Інструкція з підготовки тендерної пропозиції», Учасником та пункту 2 Таблиці 2 Додатку 1 до ТД надано Технічну документацію виробника, яка не відповідає вимогам Технічної специфікації (технічних вимог), а саме: Дизельний двигун дизельної електростанції AKSA AVP 275 має систему охолодження з використанням води, а не з рідиною антифриз, що є порушенням ТД. Враховуючи вищевикладене, тендерна пропозиція учасника ТОВ «КОМУНІКАЦІЇ ТА ІНЖЕНЕРНІ МЕРЕЖІ» підлягає відхиленню на підставі абз. 2 пункту 2 частини першої статті 31 Закону України «Про публічні закупівлі».
