Explanation

Відміна тендеру відповідно до ч.2 п.1 статті 32 ЗУ «Про публічні закупівлі»: неможливо усунути порушення, що виникли через виявлені порушення законодавства у сфері публічних закупівель, з описом таких порушень, які неможливо усунути. Опис порушень: під час оголошення закупівлі помилково було встановлено розгляд пропозицій без ПДВ; у проєкті договору передбачена можливість зміни суми договору постачальником. За таких умов сума у договорі, який передбачено для укладання, може бути відмінною від ціни тендерної пропозиції переможця, що суперечить п.4 статті 41 ЗУ «Про публічні закупівлі»: "Умови договору про закупівлю не повинні відрізнятися від змісту тендерної пропозиції/пропозиції за результатами електронного аукціону (у тому числі ціни за одиницю товару) переможця процедури закупівлі/спрощеної закупівлі або узгодженої ціни пропозиції учасника у разі застосування переговорної процедури, крім випадків визначення грошового еквівалента зобов’язання в іноземній валюті та/або випадків перерахунку ціни за результатами електронного аукціону в бік зменшення ціни тендерної пропозиції/пропозиції учасника без зменшення обсягів закупівлі."
